Filing a paternity action against another parent is a difficult decision. What is even more difficult, is the very detailed process and procedure(s) involved in handling your Paternity matter competently. You want to make sure that you are asserting your legal grounds, so that the judge can grant you the relief you are indeed looking for. To be honest, the area of Family Law can be very fact-intensive, and as a result, it is immensely important that you communicate the factual circumstances in a very unambiguous fashion, so the judge can make the best ruling possible (given the obvious factual circumstances). Please note that this is why it is vital, that you retain the right attorney to handle your Family Law legal matter.
If you choose to retain our law firm to handle your legal matter, we will ensure that we allege all of your wishes in accordance with the law when it comes to filing your paternity action. There are many aspects of a paternity action that must be resolved, and if not handled properly by a competent Family Law Lawyer, the outcome you were hoping for, may not be within reach. Before anything else can be determined, paternity must first be established. Either parent can elect that the other parent take a DNA test to determine whether the Father is the natural Father of the child, however, please note that if your name is on the birth certificate, and you have not contested the validity (as to whether you are the father) within 60 days, Paternity has been established by a matte of law. Another way Paternity can be established, is by acknowledgment. The next step that must be determined is parental responsibility. The parent who has parental responsibility would have the decision making power to make the major decisions in regards to the child’s education, medical care, etc., if ultimate decision making is granted (or sole-parental responsibility). Time-sharing (formerly known as custody) is also determined in a paternity action and is established according to the standard of the best interest of the child(ren). There are a number of factors outlined in the Florida Statutes that judges utilize to determine a fair time-sharing or custody schedule. Child support is determined by four major factors including income of both the parents, the expenses of daycare, and health insurance. There are other factors that may influence child support is the amount of time-sharing that both parties share with the minor child and other child support orders for other children.
